OUR TERMS OF SERVICE

TERMS OF PAYMENT

The design fee is usually due in full to begin development of your website unless an alternative contract or proposal specifies a different amount. You agree to follow our payment schedule.

RECURRING CHARGES

These payment obligations cover hosting and support as specific in your contract or proposal. Your account will be automatically billed on the fee structure monthly unless you give Concrete Web Design a written five (5) day notice to change your method of payment or cancel services.

CANCELLATIONS

If web development and services has begun then the design fee is nonrefundable. We reserve the right to offer partial refunds depending on circumstances at our sole discretion. You have the right to modify, reject, cancel, or stop any and all plans or work in progress. However, you agree to reimburse us for all costs and expenses we incurred prior to your changes in instructions, and which relate to non-cancelable commitments, and to defend, indemnify and hold us harmless for any liability relating to such action. We agree to use or best efforts to minimize such costs and expenses.

HOSTING TRANSFER

If you wish to cancel your service and transfer your hosting to another provider, Concrete Web Design will email your site code to you within fifteen (15) business days. Concrete Web Design cannot guarantee the elements of the site will work on another server.

MUTUAL COOPERATION

We agree to use our best efforts to fulfill and exceed your expectation on the deliverable goods included in your contract or proposal. You agree to aid us in doing so by making available to us the needed information pertaining to your website and to cooperate with us in expediting the work.

GOVERNING LAW

The contract or proposal shall be governed and constructed in accordance with the laws of the State of Oregon.

REPRESENTAION AND WARRENTIES

The parties each individually represent and warrant that each has full power and authority to enter into an agreement and to perform all of their obligations hereunder without violating the legal or equitable rights of any third party.
